Marcelo Araújo: Acender ou não acender os faróis durante o dia dentro da cidade?

Faróis acesos em Curitiba?!

Começou a vigorar na última sexta-feira a Lei 13290/16 que estabelece a obrigatoriedade da manutenção dos faróis acesos com a luz baixa nas rodovias, durante o dia e durante a noite. A primeira confusão já começa no próprio Art. 40 do Código de Trânsito, pois a citada Lei incluiu no inciso I do referido artigo o uso da luz baixa dos faróis, além dos túneis iluminados, também nas rodovias, de dia e de noite. O mesmo Art. 40 no inciso II estabelece que à noite, nas vias não providas de iluminação, deverá ser usada a luz alta dos faróis. E aí, numa rodovia sem iluminação pública, durante a noite, deve ser usada a luz baixa como diz o inciso I do Art. 40, ou a luz alta como diz o inciso II do mesmo Art. 40?

E em Curitiba, é obrigatório o uso dos faróis baixos durante o dia? Curitiba é uma cidade densamente povoada e conturbada com os municípios fronteiriços, mas algumas rodovias adentram seu perímetro, tanto federais (BR) quanto estaduais (PR) e a Lei 13.290/16 não faz distinção.

O conceito de rodovia trazido no Código de Trânsito em seu Anexo I é muito infeliz, como ‘vias rurais pavimentadas’, porém o fato de cortar o trecho urbano de um município, muitas vezes assumindo o nome de avenida, não tira afasta sua condição de rodovia, sendo o órgão rodoviário, estadual ou federal, responsável pela fiscalização. Para relembrar essa ‘aula’ sobre territorialidade ministrada aqui no Blog.

Vamos a elas.

A BR-277 vem do litoral do Paraná, adentra entre o Capão da Imbuia e Uberaba, até pouco antes do Jardim Botânico. Sai em direção a Ponta Grossa quando acaba a Mário Tourinho, logo após a ponte do Rio Barigui, entre Santo Inácio e Mossunguê.

Na região do Atuba há o encontro da BR-116 com a BR-476, e todo o trecho da ‘Linha Verde’ é a antiga BR-116, atualmente BR-476.

A PR-415 vem de Pinhais para Curitiba mas na divisa passa a ser a Av. Victor Ferreira do Amaral, mas em Pinhais é rodovia, chamada João Leopoldo Jacomel.

A PR-418 é conhecida por ‘Contorno Norte’ e se encontra com a PR-417 na divisa do Bairro Santa Cândida com Colombo.

A Avenida Manoel Ribas em Santa Felicidade vira PR-090 após cruzar o contorno, em direção a Campo Magro.

A BR-376 é uma continuidade da PR-418 quando passa a ser o ‘Contorno Sul’, seguindo em paralelamente à Juscelino K. de Oliveira pela cidade Industrial.

Abrimos um parêntesis para ressaltar uma questão que não está bem explicada, como é o caso da Juscelino Kubistschek por ser uma marginal paralela à rodovia, porém na chamada ‘Faixa de Domínio’, sendo sinalizada e conservada pelo município, mas por vezes gerando conflito na fiscalização com a PRF.

A ‘Linha Verde’ tem toda a ‘cara’ de avenida, a conservação já foi delegada ao município, há convênio de fiscalização com a SETRAN, mas como disse anteriormente, é um trecho da BR-476. Com o convênio tanto a PRF quanto a SETRAN podem autuar o farol apagado, mas imagine você receber uma cartinha da SETRAN e outra da PRF por essa infração rodoviária.

Por falar em iluminação nesta quinta a ‘Tocha Olímpica’ vai passar pela antiga ‘Cidade Sorriso’ (atual República das Capivaras), e consequentemente haverá necessidade de um controle e organização do trânsito. No início da gestão em 2013 o primeiro secretário de trânsito do atual prefeito anunciava o envio a Câmara Municipal de projeto para criação do cargo de agentes de trânsito, e quando foi aprovado e sancionado no afogadilho era para dar apoio na Copa do Mundo.

Já estamos na ‘Tocha Olímpica’ e vina, ‘vinada’, como aliás eu já previa na época, que não passava de firula. Minha sugestão de credenciar Guardas Municipais não foi seguida por covardia, e o tempo mostrou que isso foi reconhecido legal e constitucionalmente. Não preciso dizer mais nada, além de ‘VINADA’!

De multa eu entendo!
